The Indiana District, CPUSA expresses condolences to the family and friends of the late Ruth Bader Ginsburg. Further, we demand that the Republican Senate honor Ruth Bader Ginsburg’s final words, “My most fervent wish is that I will not be replaced until a new president is installed.”
The loss of the Justice creates a perilous situation for democracy and the rights of working people in the United States. The importance of Ruth Bader Ginsburg’s tenure on the Supreme Court to the working class was in her stands against some of the worst excesses of the right wing. Nevertheless, The Lilly Ledbetter Fair Pay Act would not have been passed by Congress were it not for Ruth Bader Ginsburg’s dissent in Ledbetter v. Goodyear Tire and Rubber Co. In it, she wrote, “The Court does not comprehend or is indifferent to the insidious way in which women can be victims of pay discrimination.” And again in Shelby County, Alabama v Holder, she challenged the attempt to deny African Americans the right to vote.. Her dissents laid bare the fact that our court systems packed with right-wing judges will give legal cover to ruling class chauvinism, White supremacy, and ruthless exploitation by unregulated corporations that place profit over people.
The precedent set by Senate Republicans in 2016, a Presidential election year, delaying the confirmation of a new Supreme Court Justice following the death of conservative Justice Antonin Scalia, contradicts their position today. After Scalia’s death in February 2016, the Republican-controlled Senate delayed the vote for a replacement until a month after Donald Trump was inaugurated in January 2017. With less than 2 months until the November 3rd Presidential election and with some states already casting early votes, the rush to confirm a nominee highlights the Senate’s anti-democratic composition, rules, and power as evidenced by the historical use of the filibuster to enshrine a minority, White-supremacist agenda and derail Civil Rights legislation.
The Republican Party, representing the most racist, nationalistic, theocratic, and anti-democratic forces in the ruling class, endeavors to secure the courts from overturning legislation aimed at destroying working-class rights, such as a woman’s right to an abortion, equal pay, work-place and environmental protections, labor organizing, as well as free and fair elections at an even faster pace than could happen otherwise.
It is imperative that all people, Black, Brown, White, as well as LGBTQ+ working people unite to fight the attempt to further undermine the US peoples democratic power from the rapidly encroaching right-wing authoritarianism represented by the Republican Party. This means registering and voting in the election, contacting representatives through phone calls and writing, registering neighbors to vote, phone-banking, supporting union organizing and strikes, and engaging in mass mobilizations with the working-class organizations, and building the Communist Party, USA to combat the encroaching fascist elements that will ramp up if Donald Trump is re-elected. The fight to protect a Supreme Court seat is an integral part of preserving democracy, which will dictate the conditions upon which we are able to fight for a true working-class democracy.
Our specific fight as workers is to understand the conditions as they are and fight to support working class victories and organize to defeat any nominee who threatens those victories regardless of who wins the election.
